By visiting our site and/or purchasing something from us either in our physical store, via our online website or over the phone, you engage in our “Service” and agree to be bound by the following terms and conditions. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use our Service.

USE OF THE WEBSITE
Users may only use the Website in accordance with these Terms. Our store is hosted on Shopify Inc. Shopify provides us with the online e-commerce platform that allows us to sell our products and services to you.

The Wild Flower makes no representation or warranty that the Website is appropriate or available for use in all countries or that the content satisfies the laws of all countries.

Users may only access the Website through standard web browsers, and not via methods such as scraping, data mining, the use of a robot or spider, automation or any similar method of extraction or monitoring.

NO ILLEGAL USE
No user may use our Website or our products/services for any illegal or unauthorised purpose. No User may publish or use The Wild Flower’s trademarks, branding, brand or logos without The Wild Flower’s prior written consent.

INTERFERENCE WITH THE WEBSITE
Users must not introduce, cause the introduction of, or transmit any worms or viruses or any code of a destructive nature that in any way compromises or may compromise the Website.

WEBSITE MALFUNCTIONS
We will attempt to promptly address all technical issues that may arise on the Website. We are not liable for any loss or damage caused as a result of any Website malfunctions, the Website being down or performing slowly, or any viruses or other forms of interference that may damage the User’s computer system.

CHANGES TO WEBSITE
We are permitted to modify the contents of this site at any time, but we also have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

USE OF IMAGES AND PHOTOGRAPHY

PRODUCTS AND SERVICES
Some products and/or services may have limited quantities and we also reserve the right to limit the sales of our products or services to any person or geographic region. We may exercise this right on a case-by-case basis.

All descriptions of products and pricing are subject to change at anytime without notice, at our sole discretion. We reserve the right to discontinue any product at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Our products are subject to return or exchange only according to our Return Policy (below).

We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any colour will be accurate. 

ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

USER INFORMATION
Upon registering to use The Wild Flower’s products and/or services via the Website, all users agree to provide true, accurate, current and complete information about themselves as prompted by the Website and to promptly notify us of any changes to their User Information in order to ensure that it remains true, accurate, current and complete.

INDEMNIFICATION
Each user agrees to indemnify, and will keep indemnified, The Wild Flower against all forms of liability, actions, proceedings, demands, costs, charges and expenses which The Wild Flower may incur or be subject to as a result of that user’s use of the Website or breach of these Terms of Service.

PAYMENT
When ordering online, we offer a number of payment options including: Shopify payments (powered by Stripe), PayPal, POLi Internet Banking, and Afterpay.

Shopify payments (powered by Stripe) is used to complete most online purchases. As part of the payment process Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, Paypal, American Express.

All prices are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) of 15%.

FLOWER SUBSTITUTION POLICY
Every effort will be made by our florists to match the style and colour scheme of your order, as shown in the photo. While our florists will attempt to use the exact flowers pictured, flowers are seasonal and as such we may need to substitute a different variety of flower in from time to time. Any substituted flowers used will always achieve the same style and colour tones of the bouquet you have selected and all substitutions will be of equal value or higher.

DELIVERY POLICY
For flower deliveries in the Wellington region, we use Sub60 floral couriers, and on occasion we also use our own in-house delivery service.

WEDDING POLICY
Upon booking your wedding with us, we require a 20% deposit. If for whatever reason you would like to cancel your wedding order, we require 1 month’s notice. Your initial deposit is not refundable.

ORDER AMENDMENTS & ORDER CANCELLATIONS
You can make a change to your order within a reasonable timeframe before delivery. Please contact us as soon as possible if you need to make a change to your order.

If you wish to cancel your order immediately after placing it, we can offer a full refund – please call our friendly staff ASAP. However, if your bouquet has been made and/or it is out for delivery, we are unable to offer a refund.

REFUND POLICY
If you are not entirely happy with your flowers or gifts please call the shop within 24 hours of receipt. We will discuss the issue and decide on a suitable course of action.

Please note that fresh flowers are perishable and cannot be exchanged or refunded. Shipping costs are also non-refundable. For products, such as gifts, we will always meet our requirements under the Consumers Guarantees Act.

PERSONAL INFORMATION
We are committed to the protection of personal information in compliance with New Zealand laws and we will keep all your personal information confidential. All information, data or other content generated through each user’s use of the Website is governed by our Privacy Policy. Please refer to our Privacy Policy for more information.

SEVERABILITY
If any provision in these Terms becomes invalid or unenforceable, the remainder of these Terms will remain valid and enforceable to the fullest extent permitted by law.

TERMINATION
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If a User does not abide by these Terms, The Wild Flower may terminate or suspend that User’s account with us and refuse to provide any products/services to that User. We reserve the right to refuse service to anyone for any reason at any time.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, testimonials, proposals, plans, or other materials, whether online, by email, by mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party. 

ENTIRE AGREEMENT 
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. The Wild Flower will not be deemed to have waived any rights under these Terms unless expressed in writing and signed by The Wild Flower. A failure to exercise (or a delay in exercising) any right by The Wild Flower under these Terms will not equal a waiver of that right. Any waiver will not constitute a waiver of any subsequent rights or any other provision in these Terms.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
